Will I get jail time?
This is one of the most common questions I get as a Criminal Defense attorney. The answer, of course, will depend on the facts of the case. In order to answer it, we will need to sit down and go over what happened as well as your
history.
A first time offender in a Domestic Violence case with no injuries may not get any active jail time while a repeat offender or a case with "bad" facts may yield jail time. The amount will depend on the facts of the case.
Even the lowest level of Assault is a gross misdemeanor - which means that you could get up to a year in jail and a $5,000 fine. More serious Assaults are felonies and can carry considerably more jail time.
